1. GENERAL
    1. Starbright does not provide technical support for any external hosting providers chosen by the client (i.e. if you select not to host your website with us).
    2. Hosting services exclude additional services such as website updates, security maintenance, and others unless explicitly stated.
    3. If the client chooses to host the domain or website elsewhere:
      1. Starbright cannot guarantee that the website is fully compatible with third-party hosting provider server operating systems, including but not limited to contact forms, Content Management Systems (CMS), or database-driven websites.
      2. Starbright takes no responsibility for server maintenance or updates.
    4. The laws of the Republic of South Africa govern these terms and conditions.
    5. Given the constantly evolving nature of cybersecurity threats, no website can be entirely immune to hacking attempts. Starbright is not liable for damages or losses resulting from security breaches, hacking, or other forms of unauthorised access to your website.
  2. FINANCIAL POLICY
    1. All hosting fees are exclusive of VAT unless otherwise stated.
    2. Hosting fees must be paid in advance, including setup fees and the first month’s hosting.
    3. Domain, website hosting, and email services will be suspended by the 7th of the month if payment is not received.
    4. Hosting fees are non-refundable should the client switch to another provider during the paid hosting term.
    5. Domain renewal costs are as follows:

    6. If Starbright is required to back up and move client email accounts, an additional support fee will be quoted and charged.
    7. A small administrative fee, as outlined in the Hosting Proposal, applies when switching the client to another hosting provider.
    8. Monthly invoices are issued on the 15th of each month.
    9. Funds are strictly non-transferable between services. Each service requires its own dedicated funding to ensure effective resource allocation.
  3. SUPPORT
    1. Telephonic domain support fees are calculated as follows:
      1. The first 15 minutes are free.
      2. Beyond 15 minutes, clients will be charged R750 per 60 minutes (prorated in increments, e.g., 30 minutes = R375).
  4. HOSTING TERM/DURATION
    1. By selecting “per year” hosting in the Proposal, the client agrees to a minimum contract period of 12 months.
    2. Hosting renews on a month-to-month basis after the initial contract period, until written cancellation is received.
    3. Domain names are renewed annually unless otherwise agreed upon.
    4. Clients are responsible for the timely payment of domain registration fees. Failure to pay may result in loss of the domain, for which Starbright will not be liable.
    5. Domain names will be suspended if annual hosting fees are not paid within the specified period.
  5. CANCELLATION AND TERMINATION
    1. Starbright reserves the right to suspend or terminate hosting, email, and related services due to non-payment.
    2. A calendar month’s written notice is required to cancel hosting services. Submit cancellations via https://cancel.starbright.co.za/.
    3. Verbal cancellations will not be accepted.
    4. Services will be billed on a recurring basis unless Starbright is notified in writing to terminate them.
  6. DOMAIN NAMES
    1. Starbright may purchase domain names on behalf of clients.
    2. Payment for and renewal of domain names is the client’s responsibility.
    3. Starbright is not liable for loss, cancellation, or other domain-related issues due to late or non-payment.
  7. HOSTING LIMITATIONS AND EXCEPTIONS
    1. Shared hosting is only available for domains that:
      1. Use less than 20GB of combined disk space for email and/or website content.
      2. Do not require excessive server CPU or memory usage.
    2. For domains exceeding these limits, Starbright will provide a custom hosting solution quotation.
    3. Should the client reject the custom hosting solution, Starbright reserves the right to issue a cancellation notice.
  8. THIRD-PARTY PRODUCTS
    1. Any third-party software provided by Starbright will be governed by the licensor’s standard terms.
  9. HOSTING DISCLAIMER
    1. Starbright partners with professional, world-class ISPs offering at least 99% server uptime. However, Starbright is not responsible for email loss, business interruptions, or downtime caused by hosting issues or countrywide network problems.
    2. Planned or unplanned server/network maintenance may occur at any time without prior notice.
    3. Sending unsolicited commercial emails (SPAM) through Starbright’s web servers is prohibited and may result in account suspension or termination without refund. Mailing lists must include clear opt-in methods and removal procedures.
    4. Starbright operates under a fair usage policy. There is no traffic limit for hosted websites and email addresses, but excessive usage may result in review.
    5. Incremental website backups are conducted daily and retained for two weeks. While Starbright employs best practices, the usability and integrity of backups cannot be guaranteed.
    6. Starbright is not liable for losses or damages resulting from service interruptions or unavailability.
  10. WARRANTIES
    1. Starbright warrants that its chosen hosting provider, Xneelo, has the infrastructure, capacity, and capability to deliver hosting services effectively.
    2. Hosting services are provided “as is” and “as available.” No additional warranties are provided, whether express or implied unless specifically required by law.
