1. GENERAL
    1. Starbright does not offer any technical support for any other website hosting company that you may choose (if you elect not to host the website with us).
    2. Hosting excludes any other services such as website updates, security maintenance etc.
    3. If you are hosting the domain or website elsewhere;
      1. We cannot guarantee that the website is fully compatible with all hosting provider’s server operating systems, especially any contact forms, Content Management Systems, database driven websites, etc.
      2. We do not take any responsibility for server maintenance or updates
    4. The laws of the Republic of South Africa shall govern this proposal.​
    5. Given the constantly evolving nature of cybersecurity threats, it is important for clients to understand that no website can be rendered completely immune to hacking attempts. Our agency is not liable for any damages or losses resulting from security breaches, hacks, or other forms of unauthorised access to your website.
  2. FINANCIAL POLICY
    1. All hosting fees exclude VAT unless stated otherwise.
    2. All hosting fees are payable in advance.
    3. Hosting setup fees and the first month’s hosting are to be paid in advance.
    4. Domain, Website Hosting and Email will be suspended by the 7th of the month should no payment be received.
    5. Hosting fees are not refundable should the client decide to move to another provider within the hosting term already paid for.
    6. Domain renewal costs are as follows:
      1. .co.za = R165 ex VAT
      2. .com = R300 excl VAT
      3. .net = R380 excl VAT
      4. .info = R510 excl VAT
      5. .biz = R490 excl VAT
      6. .org = R280 excl VAT
      7. .co = R650 excl VAT
    7. Prices may vary depending on the technology used for each hosting package.
    8. In the event where Starbright needs to back up and move email accounts for the clients, an additional support fee will be quoted for and charged.
    9. A small admin fee, stipulated in the Hosting Proposal, is payable for switching the client to another hosting provider.
    10. Monthly invoices will be sent on the 15th of each month.
    11. Funds are strictly non-transferable between different services. Each service requires its own dedicated funding. This policy ensures that resources are allocated and managed effectively to deliver optimal results for each individual service.
  3. SUPPORT
    1. Telephonic domain support fees are calculated as follows:
      1. The first 15 minutes will be free.
      2. Should the support time surpass 15 minutes, the client will be charged R750 for every 60 minutes thereafter of increments therof. i.e. 30 mins = R375, 60 mins = R750 etc.
  4. HOSTING TERM/DURATION
    1. By selecting the “per year” hosting on the Proposal, the client agrees to a 12-month (minimum) contract period.
    2. Hosting will renew on a “month-to-month” basis after initial expiration and until cancellation has been received.
    3. Domain names are renewed annually unless otherwise required.
    4. Clients failing to pay their domain registration fees will be at risk of losing their domain.
    5. Starbright takes no responsibility for the loss of a domain name due to lack of timeous payment.
    6. Domain names will be suspended if annual hosting fees are not paid within the specified time limit.
  5. CANCELLATION AND TERMINATION
    1. Starbright reserves the right to suspend or terminate hosting, email and other services should there be payment delays.
    2. A calendar months’ notice is required for cancellation of hosting services, to be supplied in writing by visiting https://cancel.starbright.co.za/
    3. Verbal cancellations will not be accepted.
    4. The client agrees that unless they notify Starbright of their desire to cancel any or all services received, those services will be billed on a recurring basis.
  6. DOMAIN NAMES
    1. Starbright may purchase domain names on behalf of the client.
    2. Payment in relation to, and renewal of, those domain names is the responsibility of the client.
    3. The loss, cancellation or otherwise of the domain brought about by non or late payment is not the responsibility of Starbright.
  7. HOSTING LIMITATIONS AND EXCEPTIONS
    1. Shared hosting will only be available for domains that:
      1. Use less than 20GB of combined disc space for email and/or website content.
      2. Do not require excessive server CPU or memory usage.
    2. In the event that a domain’s requirements exceed the above shared hosting exclusions, a custom hosting solution will be quoted for the domain’s specific needs.
    3. Starbright reserves the right to give cancellation notice in the event that the custom hosting solution quotation is rejected.
  8. THIRD-PARTY PRODUCTS
    1. Any third-party software which Starbright agrees to provide shall be supplied in accordance with the relevant licensor’s standard terms.
  9. HOSTING DISCLAIMER
    1. Starbright uses professional world-class ISPs and their server uptime is at least 99%. Starbright cannot be held responsible or legally accountable for loss of email, loss of business or website downtime due to hosting problems or countrywide network problems.
    2. Planned or unplanned server or network maintenance may be performed at any time without prior warning.
    3. The sending of unsolicited commercial emails (SPAM) through our web servers promoting any website, or via third party web servers promoting a website hosted by us, can result in the suspension or termination of the client’s web hosting account, without refund. Mailing lists may be operated as long as individuals choose to subscribe to receive mailings via clear ‘opt in’ methods and a strict removal procedure is published in all mailings. ‘Safe lists’ and other advertising related mailing lists might not be operated. Any complaints received are taken seriously and will be investigated.
    4. There is no limit on traffic for each website and email address hosted by Starbright, although fair usage rules may apply.
    5. Incremental website backups are processed daily and are kept for 2 weeks. We implement a best effort policy, but the usability and integrity of these backups is not guaranteed.
    6. Starbright cannot be held liable for any losses or damages suffered as a result of interruptions or unavailability of service.
  10. WARRANTIES
    1. We warrant that our chosen hosting company Xneelo has the facilities, infrastructure, capacity, and capability to provide hosting services.
    2. Despite this warranty, the hosting services are provided “as is” and “as available”. No warranty of any kind is given, whether express or implied, including warranties of merchantability, title, or non-infringement, except where such a warranty is specifically required by law.
